CoinSwitch Pro Warriors League : Diwali Edition - T&Cs

  1. CoinSwitch is hereby offering all the Users of CoinSwitch Pro the opportunity to participate and receive rewards in Indian Rupees or bullion, or electronic goods of equivalent Indian Rupee value, as deemed fit by CoinSwitch (“Rewards”) in its Warriors League : Diwali Edition (the “Program”) as per the terms contained herein (“Program Terms”). We reserve the right to amend or terminate the Program at any time, for any reason, without prior notice or any liability to You. The User hereby agrees and acknowledges that upon participating in the Program, and/or any other information, service, or feature governed by Terms of Use (“Terms”) and/ or Program Terms contained herein, the User shall be bound by the Terms and these Program Terms, as updated, modified, and/or replaced from time to time at the sole discretion of CoinSwitch without any prior notice to You. You are advised to review these Program Terms for any amendment, replacement or changes to the terms contained herein and any future use or access to any services covered herein. These Program Terms incorporate, by reference, and supplement the Terms and the Trading Policy.
    Capitalized terms used but not defined herein shall have the meanings given to them in the Terms and/or the Trading Policy. In the event of a conflict between the Terms and these Program Terms or the Trading Policy and these Program Terms, these Program Terms will prevail to the extent of the conflict.

  2. Additional Eligibility Criteria: In addition to the Eligibility Criteria under the Terms, by participating in the Program, You represent and warrant that Your participation in the Program is not prohibited under any applicable laws.

  3. Program:
    A. Subject to the Eligibility Criteria, all Users of CoinSwitch Pro are eligible to participate in the Program and receive the Rewards as per the Program Terms.
    Under the Program, CoinSwitch in its sole discretion subject to the Terms, Trading Policy and the B. Program Terms, will distribute Rewards to 20 (Twenty) Users with the highest Indian Rupee volume of executed trades during the Term (defined hereinafter) of the Program, subject to the minimum trading volume mentioned hereunder:

    You acknowledge and agree that in the event the User eligible to receive the Reward does not meet the minimum trading volume requirement for that rank, the User will receive the Reward for the next rank where the minimum trading volume requirement is met.

    For calculating the executed trading volume, INR trading volume from CoinSwitch Pro user interface, and INR trading volume from CoinSwitch Pro API will be considered. In case of trades executed on Binance, a cryptographic token exchange platform operated by Binance Holdings Limited or its affiliates, INR volume of USDT trades will be considered based on the USDT-INR rate at the time of execution of trade.

    C. Term: The term of the Program (“Term”) will begin at afternoon (12 p.m.) on October 25, 2023, and end at 11:59 a.m. on November 14, 2023. CoinSwitch, in its sole discretion, may amend the Term without any prior notice or liability to You.
    D. Rewards: The Users will be able to view their real-time/ near real-time ranks and trading volumes on the leaderboard hosted on the Program webpage throughout the Term of the Program. By participating in the Program, You hereby consent to allowing CoinSwitch to display Your full name and trading volume on the leaderboard on the webpage of the Program. CoinSwitch will announce the Users eligible to receive the Rewards on the Platform on or before November 15, 2023. CoinSwitch’s decision in this regard shall be final and binding. All the eligible Users will receive the Rewards, after deduction of the applicable taxes, only in the User’s LLP Account on or before December 15, 2023. You acknowledge and agree that there may be a delay in receipt of the Rewards in the User’s LLP Account on account of events beyond the control of CoinSwitch, including but not limited to any technical difficulties or complaints raised by the participants in the Program. Notwithstanding anything stated in the Program Terms, Terms or Trading Policy, You acknowledge and agree that in the event that multiple Users sharing the same IP Address or the same device ID are eligible to receive the Rewards under the Program, then out of all such Users only the User with the highest trading volume in Indian Rupees will be eligible to receive the Rewards under the Program.

  4. Service Fee
    During the Term of the Program, the service fee charged by CoinSwitch to all CoinSwitch Pro Users will be subject to certain volume-based discounts enumerated     here for trading volumes executed on Coinswitch Pro user interface. For trade volume executed on API, a fixed fee will be charged which is enumerated here.

  5. Taxes
    A TDS of 10% will be applied on Rewards under the Program and the same will be deducted at the time of crediting the Reward.

    Users who are opting for electronic goods or bullion as Rewards, TDS of 10% will be deducted from their wallet and a ledger entry will be passed in the name of Rewards TDS.

  6. Disqualification

    CoinSwitch reserves the right to disqualify any Users from participation in the Program and cancel or clawback any Reward credited or to be credited under the Program at any time at its sole discretion, for any reason at any time, including but not limited to:

    A. Violation of Program Terms or Applicable Law: If the User does not comply with or violates any of these Program Terms or otherwise fails to comply with any applicable laws (including, without limitation, through any failure to include any required statutory and regulatory disclosures or otherwise required by CoinSwitch).
    B. Fraudulent or Suspicious Behavior: If CoinSwitch determines that such User is attempting to undermine the fairness, integrity, or legitimate operation of the Program in any way by cheating, hacking, deception, or any other unfair playing practices intended to annoy, abuse, threaten, or harass any other Users or any representatives of CoinSwitch.
    C. Prohibitions: Use of any affiliate website, affiliate network properties, automated systems, script, or macro to participate is strictly prohibited and will result in disqualification.

    CAUTION: ANY ATTEMPT TO DELIBERATELY DAMAGE OR UNDERMINE THE LEGITIMATE OPERATION OF THE PROGRAM MAY BE IN VIOLATION OF CRIMINAL AND CIVIL LAWS AND WILL RESULT IN DISQUALIFICATION FROM PARTICIPATION IN THE PROGRAM. SHOULD SUCH AN ATTEMPT BE MADE, COINSWITCH RESERVES THE RIGHT TO SEEK REMEDIES AND DAMAGES (INCLUDING ATTORNEY FEES) TO THE FULLEST EXTENT OF THE LAW, INCLUDING CRIMINAL PROSECUTION.

  7. Fraud

    You acknowledge and agree that CoinSwitch may delay the credit of the Rewards on account of an investigation into any fraud, misrepresentation, or malfeasance of any kind by any of the Participants in the Program. If You find someone misusing the terms of this Program, You may let us know by contacting us directly at support@coinswitch.co. CoinSwitch will investigate the matter and take the necessary steps without prejudicing our rights and remedies available under the laws. In case of any dispute, the decision of CoinSwitch will be final and binding. By participating in the Program, You acknowledge that receiving a Reward cannot be guaranteed by CoinSwitch.
